This agreement (the "Agreement") sets out the legally binding terms for Your use of the Services provided by Shuttle Scooter Technology Norway AS ("Shuttle Scooter" . The purpose of the Agreement is to regulate the Services offered by Shuttle Scooter, after you have registered in the Shuttle Scooter App.
In this Agreement, the following words and terms are understood as follows:
• "Incentivated parking zones" means the areas defined and designated in the Shuttle Scooter App where parking is incentivized (eg using Shuttle Scooter Credits).
• "Mandatory Parking Zones" means the areas defined and designated in the Shuttle Scooter App where you must temporarily park and deactivate the Vehicle.
• "Prohibition Zones" means the areas defined and designated in the Shuttle Scooter App where the Vehicles cannot be deactivated. As you can not reactivate a Vehicle once it has been deactivated in such an area, you should as far as possible aShuttle Scooterd such an area because non-compliance may result in additional costs.
• "Operating Zone" means the areas defined and designated in the Shuttle Scooter App where the Vehicles can be activated, used, temporarily parked and deactivated.
• "Privacy Statement" means the privacy statement about Shuttle Scooter's processing of personal data, available at ____________________________________________
• "Vehicle" means Shuttle Scooters electric vehicles, such as electric scooters or electric bicycles.
• "Services" means the use of Vehicles, the Shuttle Scooter-App and associated services as described in the Shuttle Scooter-App, and made available through the Shuttle Scooter-App, together with other related equipment services and information made available by the Shuttle Scooter.
• "Shuttle Scooter-Appen" means Shuttle Scooter's proprietary software available via computer or mobile device, which may give you access to the Vehicle
1.1 The Parties to the Agreement
You and Shuttle Scooter are the sole parties to this Agreement. You are the sole user of the Services, and You must not allow anyone else to use the Vehicle.
1.2 Registration of account
To use the Services, you must register an account in the Shuttle Scooter App. You must follow the instructions given during the registration procedure and provide the correct information. You may not use the Services without proper registration. You can only register one account for You and only need to make one registration. You must ensure that no one other than You uses your registration, especially with regard to the use of Vehicles. If you become aware of a risk that others will use your registration or may use your registration, for example because your computer or mobile device, through which you have access to the Vehicle, has been stolen, you must inform Shuttle Scooter as soon as possible in accordance with Section 8.
1.3 Shuttle Scooters Services
Shuttle Scooter will give you the opportunity to use the Shuttle Scooter App to find, activate, use and deactivate a Vehicle if there is a Vehicle available. All availability is displayed in the Shuttle Scooter App. Since there is a limited number of Vehicles, Shuttle Scooter can not promise that You will always find a Vehicle within a distance that is convenient for You or that You will find a Vehicle at all (see Section 1.5 below).
1.4 Your areas of responsibility and requirements for the use of the Services
You must be at least 18 years of age to use the Services offered. Minors' handling or use of the Vehicles is expressly prohibited. If you allow minors to use a Vehicle by, for example, activating it via your account, you are responsible for all misuse.
You must be physically fit and have sufficient competence to use the Vehicle, especially with regard to participation in the traffic picture and compliance with traffic rules and regulations.
You are responsible for adapting your driving to external circumstances and for determining your general ability, medical condition, weather conditions (including rain, fog, snow, hail, ice, heat or thunderstorms), and / or other factors that may pose a risk. for the use of a Vehicle. You must make your decision on and how to use a Vehicle depending on weather, traffic or other conditions, uncertainty or other factors, and must adjust, adjust and calculate speed, driving behavior and braking distance. Due to the circumstances, it may also be advisable to refrain from any use of a Vehicle at all.
You must perform a basic safety check of the Vehicle before using it. This is done with a visual check, a check of the battery capacity (see Section 1.5 below) and a check of the functionality of the brakes. Do not use the Vehicle if there are any noticeable problems (such as visible damage to the Wheel of the Vehicle, brakes, lights or frame, problems with the battery level, signs of unusual or excessive wear of any kind or other visual damage to the Vehicle or any defects in the brakes ). If you discover such problems with the Vehicle, do not use the Vehicle. We appreciate you notifying us of such issues in accordance with Section 8 below.
A Vehicle is an electric vehicle that requires it to be handled in a safe and careful manner.
1.5 Availability of the Services
Vehicles are not available at all times, even within the Operating Zones due to the following.
Availability may vary within and between different Operating Zones due to high demand.
Access to the Services may be restricted in some Operating Zones if this is necessary to ensure the safety of you or the Vehicles, for example if there is a demonstration causing traffic problems or if the weather conditions are bad or similar. Please note that Shuttle Scooter only has the right to restrict access to Vehicles, but has no obligation, unless such obligations are imposed by police authorities or the like. Section 1.4 remains unaffected. Full access to use a Vehicle may also be restricted due to other reasons such as slow zones (ie when the speed is automatically reduced by Us due to speed limits in, for example, pedestrian areas).
Battery level may affect availability according to the following:
• The battery level of the relevant Vehicle is described in the Shuttle Scooter App. It is your responsibility to check the battery level in the Vehicle to ensure that it is adequate before using the Vehicle.
• The remaining battery level in the Vehicle will decrease with the use of the Vehicle, and operational capabilities as well as speed may be reduced or discontinued in full when the battery level decreases.
• How quickly the battery level decreases may vary from time to time due to various factors such as the condition of the Vehicle and the battery, weather conditions, road conditions, Your use of the Vehicle and / or factors are beyond Our control. It is therefore not possible to relate a specific battery level to a certain distance The vehicle will be able to cover. If you are not sure whether the battery level is sufficient to reach your destination, you are advised to reconsider your intended use of the Vehicle.
1.6 Your use of the Services
Different Operating Zones. You must only activate, use, temporarily park and deactivate a Vehicle in the Operating Zone where the Vehicle was activated. The correct Operating Zone is displayed in the Shuttle Scooter App and must be checked before activating a Vehicle.
Activation, use and temporary parking of Vehicles. To use a Vehicle, you must activate a Vehicle through the Shuttle Scooter App. You need an Internet connection to do this, and it is your responsibility to ensure that your mobile device through which you can access the Vehicle works properly and that you have Internet access.
After activating the Vehicle, the rental period starts and continues until the Vehicle is deactivated. You can temporarily park the Vehicle at any time through the Shuttle Scooter app, and in such cases are responsible for reactivating the Vehicle again. The rental period will continue while the Vehicle is temporarily parked.
The maximum rental period is 3 hours, after which the trip will be ended by Shuttle Scooter.
You agree to use the Vehicle in accordance with all locally applicable laws and You will in addition at any time use the Vehicle with respect for pedestrians, property and traffic, for example in the form of (where permitted by local law) riding in bicycle lanes and not on the sidewalk, keep walking speed when driving in pedestrian areas etc.
Safety precautions when using a Vehicle You must use the Vehicle in a safe manner and take the necessary precautions to aShuttle Scooterd, among other things , accidents and injuries to persons and property. Such security measures include, but are not limited to, the following:
• Not to use the Vehicle while carrying any items that may impede your ability to safely use the Vehicle, including but not limited to, backpacks, bags, suitcases or packages that are not appropriate in size or weight.
• To only use the Vehicle itself. For the aShuttle Scooterdance of doubt, You are not allowed to carry another person , child or animal on the Vehicle.
• To never exceed the maximum weight of 100 kg (kilograms) when using the Vehicle. The maximum weight includes all items You carry in accordance with this Agreement.
• Not to use any mobile devices , including but not limited to, telephones, text messaging devices, media players or other devices while driving a Vehicle that may distract you or prevent you from using the Vehicle safely.
• Not to use a Vehicle under the influence of alcohol, drugs , medication, or other substances that may impair your ability to safely use a Vehicle.
• To wear a helmet with CE standard, equivalent or a higher standard with the correct size, fitted and fastened according to the manufacturer's instructions and all other suitable protective equipment when using the Vehicle.
• To never use the vehicle for competitions , races or similar events, including both professional and non-professional stunt or trick driving.
Parking and deactivation of Vehicles. You are responsible for parking and deactivating the Vehicle when you have completed your use.
The vehicle must be parked and deactivated in legal areas, ie the vehicle can not be parked or deactivated in any Prohibition Zone, on private property, in a locked area / non-public space or in conflict with local traffic rules and / or other legal regulations.
Shuttle Scooter has the right to charge you 250 NOK when you have parked and / or deactivated the Vehicle outside such legal areas. You can prove that the loss Shuttle Scooter has incurred is actually lower, while Shuttle Scooter reserves the right to prove that the loss is actually higher. We will try to remind you of the incorrect parking before We inShuttle Scooterce such an amount. When We consider a Vehicle as a lost count stolen, the terms of Section 1.7 apply.
You must not park or deactivate a Vehicle where there is an increased risk that the Vehicle may be damaged. When disabled and parked, the Vehicle must be in a visible area.
You agree to park the Vehicle in accordance with locally applicable laws and regulations, and You will in addition and at all times park the Vehicle with respect for pedestrians, property and traffic, for example in the form of (where permitted by local law) parking next to a wall, in the extension of a bicycle rack and to ensure that the Vehicle stands in a stable manner.
Shuttle Scooter may from time to time offer incentives if you temporarily park or deactivate a Vehicle in Incentified Parking Zones and / or require you to temporarily park or deactivate in a Mandatory Parking Zone.
We may ask you to take a picture of the vehicle you used at the end of your trip. If the picture shows that you have parked the Vehicle in a way that is safe for the Vehicle and others, we can - where this is clearly stated in writing before your ride - compensate you. We reserve the right to store this image for the purpose of compensating You as described above, as well as for the reasons stated in Our Privacy Statement.
If you have parked or disabled the Vehicle in a Prohibition Zone or otherwise outside an Operating Zone, you may not be able to reactivate it again.
Proper use of the Services You must return the Vehicle to Shuttle Scooter in the same condition as it was rented and the Vehicle must be suitable for immediate use by other users, subject to normal wear and tear and with the exception of low battery level.
You should never tamper with the Shuttle Scooter App or Vehicle in any way or for any reason.
You are and will be held financially responsible for any losses incurred by Shuttle Scooter in connection with Your use of the Services, but not if you have not acted negligently. This includes any indirect losses such as loss of income due to driving without payment, due to tampering with the Vehicle, as well as if a Vehicle becomes unsuitable for use by other users.
1.7 Lost or Stolen Vehicles
You are responsible for disabling and parking a Vehicle in an Operating Zone. You can not lock or hide the Vehicle in any way unless the Vehicle is activated. If you do not deactivate or park a Vehicle in an Operating Zone and within the maximum rental period specified in Section 1.6 above, you may be liable for a lost or stolen Vehicle as follows.
Shuttle Scooter is entitled to charge you 250 NOK in the event that the Vehicle is considered abandoned, ie the maximum rental period specified in Section 1.6 above (3 hours) has been exceeded and We can not detect attempts to lock the Vehicle or requests from You for to end the trip.
A Vehicle Activated by You may be deemed to have been lost or stolen if (i) the Vehicle GPS Unit is intentionally deactivated, (ii) the Vehicle moves after deactivation and Shuttle Scooter has reason to believe that such movement was not caused by a another user or an authorized third party, or (iii) in Shuttle Scooter's reasonable opinion, there are other facts and circumstances that indicate that a Vehicle has been lost or stolen.
If Shuttle Scooter reasonably considers a Vehicle to be lost or stolen, Shuttle Scooter shall have the authority to carry out all appropriate measures to recover the Vehicle, or, if it proves impossible, to claim compensation for the loss of the Vehicle. This includes, without limitation, involving the local police and / or Shuttle Scooter s insurance company, making a request for information from You, or, if the loss is due to Your negligence, holding You liable for the loss resulting from the loss of the Vehicle.
1.8 Accidents and other incidents
You must report any accident, crash, injury, personal injury, stolen or lost Vehicle or other similar incident to Shuttle Scooter as soon as possible in accordance with Section 8 below. In the event of an accident, Shuttle Scooter will appreciate if you can try to gather evidence, if possible, for example by taking photos or by identifying possible witnesses, in accordance with applicable law (including, but not limited to, privacy laws).
If an incident involves third party personal injury, property damage or other damage to a third party, you should report the incident to the local police station as soon as possible. This also applies if the Vehicle is stolen while it is activated by You. At the request of Shuttle Scooter and in accordance with applicable local law, You will provide Shuttle Scooter with all documents from the local police and cooperate with Shuttle Scooter and / or Shuttle Scooter's insurance company.
1.9 Compliance with local laws and regulations
In addition to the above, You agree at all times to use the Services in accordance with locally applicable laws, regulations and rules. You understand that You are solely responsible for any breaches of laws, regulations and rules in connection with Your use of the Services.
1.10 Indemnification, damage and deactivation of your account
In addition to the above, You understand that any fees, fines or other payment imposed on Shuttle Scooter or damages incurred by Shuttle Scooter due to a negligent failure of You to comply with Section 1 shall be compensated by You to Shuttle Scooter.
We reserve the right at any time to deactivate your account where We, in our sole discretion, believe that You have breached the terms of this Chapter 1.
You acknowledge that You are responsible for your driving, and that You can only claim compensation from Us for damages caused by the Vehicle, not caused by Your driving.
2.1 Prices and fees
The rental of the Vehicle is on a pay-per-trip basis or in accordance with current prices set in the Shuttle Scooter App. In all cases, prices, fees and other possible costs may be subject to taxes and other local charges, which may be charged and collected by Shuttle Scooter. You should always check prices, fees and other possible costs in the Shuttle Scooter App before activating a Vehicle.
Shuttle Scooter reserves the right to charge 5 NOK directly from your credit card when you create your account or add a new payment method to guarantee that the registered payment method is valid. This amount will be used to pay for your next trip or will be refunded after 10 days if the money is not used for a trip.
All prices and monetary values stipulated in this Agreement are in Norwegian kroner.
2.2 Discounts and promotional codes
Promotional codes (discounts) are one-time offers and can only be redeemed via the Shuttle Scooter App. Discounts can be limited to one per customer and account, and can not be combined with other offers. Discounts are non-transferable, resale or refundable.
2.3 Payment methods and disputes
You must provide Shuttle Scooter information and details of a valid credit or debit card or other payment method to register to use the Services in the Shuttle Scooter App. You confirm that You are authorized to use any credit or debit card or payment information you provide. You authorize Shuttle Scooter to charge the stated credit card, debit card or other agreed method of payment with the fees you have incurred in connection with Your use of the Services, as described in this Agreement or in the Shuttle Scooter app.
You agree to, without undue delay, notify Shuttle Scooter of any changes to your credit or debit card you have made to Shuttle Scooter.
Payments to Us can be made through third party providers of payment solutions. We are not responsible for the payment process or any costs associated with such third parties.
To dispute any fees or charges that Shuttle Scooter may charge you, you must contact Shuttle Scooter within a reasonable time from the date of the disputed fee, and provide Shuttle Scooter with any information Shuttle Scooter deems necessary, such as the date of the trip and the approximate start and end time. Shuttle Scooter requests that you contact Shuttle Scooter in accordance with Section 8 below.
2.4 Outstanding payments
Any outstanding payment for the use of the Vehicle by You or a fee imposed on the basis of this Agreement will be made by Us using the payment method described in Section 2.3. However, if the payment cannot be made due to circumstances within Your control (incorrect credit card number, change of credit card without notice or the like), Shuttle Scooter will inform You and specify a period to rectify the situation. Until then, Shuttle Scooter has the right to suspend any rental of Vehicles. If Shuttle Scooter has not received information about a reliable payment method within two weeks, Shuttle Scooter may terminate this Agreement.
2.5 Actual prices and deactivation of your account
All prices stated in Section 2 can be changed, at the same time as You have the right to terminate the Agreement in accordance with Section 6. The price can be changed during the period between activation and deactivation if you drive at a time when there are price changes (for example before and after midnight). You must check the prices that apply in the Shuttle Scooter app before activating a Vehicle.
2.6 Discounts and promotional codes
We offer special promotional codes to riders in the form of discounts on rides ("Shuttle Scooter Credits"). To use Shuttle Scooter Credits in connection with a trip, you must enter the relevant promotional code before the trip begins. In order to use a promotional code, you must have added a payment method.
Promotional codes are entered in the Shuttle Scooter App by selecting "Free rides" from the menu and then "Redeem code". To check your Shuttle Scooter credit balance, select "Profile" and then "Shuttle Scooter Credits".
Shuttle Scooter Credits will be used by default, so if you have a free trip to your account, this will automatically be your next trip. If all Shuttle Scooter Credits have been used during a trip, you will have to pay for any remaining part of the trip. If a promotional code has an expiration date, it must be used before that date. Codes cannot be extended or renewed.
Shuttle Scooter Credits are one-time offers and can only be redeemed via the Shuttle Scooter App. Shuttle Scooter reserves the right to change or cancel discounts at any time without notice. Shuttle Scooter Credits can be limited to one per customer and account, and cannot be combined with other offers. Discounts are not transferable or resale or refundable.
2.7 Share Shuttle Scooter and get free rides
You can share your promotional code with friends and earn Shuttle Scooter Credits. You do this by selecting "Free Rides" in the Shuttle Scooter app, where you will find your personal invitation code. To share your personal invitation code, press "Send Code" and select one of the available options. These options can be, for example, text, email, sharing on social media or copying your personal invitation code.
When a friend completes their first trip with Shuttle Scooter after using your personal invitation code, your account will automatically receive Shuttle Scooter Credits.
Personal invitation codes should only be used for personal and non-commercial purposes. This means that you can share your invitation link with your personal connections (ie people you know) via social media as long as you are the primary content owner. Public distribution on sites where you are the sole contributor, not the primary content owner, is not permitted. Promoting the invitation code through search engine marketing (eg AdWords, Facebook) is also not allowed.
Invitation codes only apply to an invited user's first trip and are not intended for existing users.
Existing users trying to take advantage of the referral program may have their invitation code functionality disabled.
2.8 Right to withdraw Shuttle Scooter Credits and deactivate accounts
Shuttle Scooter reserves the right to suspend user accounts and revoke referral campaigns that violate these Terms.
We reserve the right to deactivate your account at any time if you have not paid or otherwise violated this Section 2.
3.1 Limitation of liability
Shuttle Scooter is responsible for its intentional and grossly negligent conduct, and - regardless of the level and degree of guilt - for losses due to death, personal injury, health damage or liability for claims based on statutory product liability legislation including the Product Liability Act. In addition, Shuttle Scooter is liable for its negligent actions in the event of impossibility, delay in performance, non-compliance with a warranty, or breach of another essential contractual obligation. Essential contractual obligations are obligations, the fulfillment of which enables the correct execution of the contract and which you can normally assume will be complied with. In these cases, Shuttle Scooter's liability shall be limited to ordinary contractual losses that Shuttle Scooter could reasonably have foreseen when the Agreement was entered into. Shuttle Scooter disclaims any other liability (on any legal basis), which exceeds the liability mentioned above, to the extent permitted by applicable law. The aforementioned limitations of liability shall also apply in favor of Shuttle Scooter's board members, employees and deputy agents.
3.2 Force majeure
Any operational problems caused by force majeure, strikes, lockouts or lack of operational resources or raw materials, which are beyond Shuttle Scooter control and which Shuttle Scooter could not have foreseen when this Agreement was entered into, shall not impose liability on Shuttle Scooter as a result of non-delivery of the Services.
4.1 Shuttle Scooter rights
All copyrights, trademarks, business names, logos and other intellectual or industrial rights held and used by Shuttle Scooter, as well as those found on the Shuttle Scooter App or on the Website (including titles, graphics, icons, scripts, source codes, etc.) are the property of Shuttle Scooter or third party licensees. property and may not be reproduced, distributed, sold, used, altered, copied, limited or used (in whole or in part) without written permission.
4.2 Respect Shuttle Scooters property
Do not tamper with, attempt to gain unauthorized access to, modify, hack, repair or otherwise modify Shuttle Scooter's materials or hardware, source codes, information, including the Shuttle Scooter App, the Website and Vehicles, for any purpose. The Shuttle Scooter App, Website and Vehicles may only be used for the purposes set forth in this Agreement.
4.3 Respect for Shuttle Scooter intellectual property rights
You agree that the Services and other information, including all related intellectual property rights, offered and made available by Shuttle Scooter, will remain Shuttle Scooter's exclusive property and You may not in any way use Shuttle Scooter's exclusive property for commercial or any other purpose without Shuttle Scooter's written consent.
Shuttle Scooter processes your personal information in accordance with the Shuttle Scooters Privacy Statement, available at https://www.Shuttle Scooterscooters.com/no/juridisk/Shuttle Scooter-privacy-policy/.
This Agreement enters into force between You and Shuttle Scooter the first time You use the Services offered by Shuttle Scooter and will remain in effect as long as neither You nor Shuttle Scooter will terminate the Agreement.
Both You and Shuttle Scooter may terminate this Agreement at any time, subject to the commencement of a commenced lease in accordance with this Agreement. Obligations that arise as a result of breach of contract during the duration of the Agreement shall not be affected by the termination.
All disputes related to this Agreement shall be in writing and the contact information provided in Section 9 below shall be used.

All disputes arising out of or in connection with this Agreement, breaches thereof, or the content thereof, unless otherwise required by mandatory law in another jurisdiction, shall be governed by and construed in accordance with Norwegian law and shall be settled in Oslo District Court.
In Norway, you also have the opportunity to complain about the Services by contacting the Consumer Council www.forbrukerradet.no.
Please also note that disputes can be sent to online dispute resolution in the EU Online Complaints Body (ODR) available at https://ec.europa.eu/consumers/odr.
This Agreement contains the complete, final and exclusive integrated agreement between the parties with respect to this relationship. This Agreement supersedes all other prior agreements, written or oral, in connection with this subject.
Shuttle Scooter may amend this Agreement at any time. In that case, you will be notified via e-mail or via the Shuttle Scooter app. The changes are considered to have been accepted by You if you have no objections to the change within one month after the changes were communicated. Shuttle Scooter shall explicitly inform you of the importance of not correcting objections. The changes will in all cases be considered accepted if you implement an agreement on the Services via the Shuttle Scooter app after the new terms have been made available. The new versions of the Agreement will also be available in the Shuttle Scooter App .
Earlier versions of this Agreement will not be archived by Shuttle Scooter. It is therefore recommended that you print and save
outdated versions of these terms.
Please note that you have no right of withdrawal after you have started a trip. Each trip starts with your express prior consent, and Shuttle Scooter will then have fulfilled its obligations under the contract.
